Many deeds (not SUPERCentral) may contain spelling or typographical errors. These errors may be innocuous but in some instances they impact the validity or operation of the deed. A deed of rectification corrects these errors in an existing deed.
We advise on the need for a deed of rectification and the need to avoid a resettlement of the trust and then we draft documents accordingly. In some instances in addition to rectifying the error, the deed must also ratify (validate) any actions or decisions made as a result of or in reliance on the incorrect parts of the deed.
