What Counts for the Minimum Pension Cap?
6 August 2013
A superannuation lump sum arising from a partial commutation will count towards satisfying the minimum pension payment limit. This is the effect of Self Managed Superannuation Funds Determination 2013/2.
However, the superannuation lump sum must be “cashed out” from the super system for this to apply.
Merely partially commuting the pension to rollover the lump sum arising from the commutation will not satisfy the minimum pension limit.
Further, as transition to retirement income streams cannot be cashed out before an unrestricted release condition has occurred in respect of the income stream, then the Determination will not apply to such income streams unless and until an unrestricted release condition occurs.
