Estate planning tends to focus on death. However, in a modern world where often our bodies are outliving our brains, we need to address the issue of incapacity - especially in the context of SMSFs and clients in retirement pension phase when loss of capacity is most likely to occur. Enter the humble appointment of enduring power of attorney, often seen as the 'sidekick' to the Will, but no longer! This session dives deep into the issues around incapacity for SMSF clients and how appointing one or more enduring attorneys for different purposes can solve even the trickiest of situations, and how to be creative with drafting in order to tackle issues such as conflicts of interest and interactions with BDBNs.
